I have had this bug for a few months before emailing the list. The only cure I have is to unload the driver and compile the driver into the kernel. This makes it rock solid. There must be a problem when the driver loads, maybe timing. Anyway my nic works every time now. I'll trouble shoot a bit more next kernel update I do.
