I agree with the others, it should stay on. What is your reason for wanting to turn it off by default?
I often manage to drag windows by mistake when I miss the element I was aiming to click on and there is some residual mouse movement. Since most of my windows are maximised this causes them to un-maximise and I then have to max them again.
