I think a DR should be held off until the package does not build anymore. There is significant work involved getting a package back into Factory again, because it would count as a new package and thus shown up on legal-team's action list.
Being scared of legal review is not a reason to keep a useless package in Factory. If, as Guido says (and I do trust him on this), the usecases for the package are no longer given, there is absolutely no reason to keep the package around. If, at any future moment in time, it might be bumped to live in sync with the feature set expected, it can re-enter. And, frankly, the legal team is doing a great job at reviewing things...
