Well if they were published > 70 years ago, they are in PD.
Speculations don't help people..... A work becomes "Gemeinfrei" 70 years after the death of the Author. "Mein Kampf" would have become Gemeinfrei May 1st 1995 bacause at that time, the time frame has been 50 years but then (for this reason and because of a special wish from Disney) two years before, the time was extended by 20 years. If this does not happen again, the next date will be May 1st 2015. In any case, "Geimeinfrei" does not mean that other people could claim authorship (without modifying it first) and set up a license like the GPL. So please come back to reality.....
