I talked to the XSane author and the dialog is there
very intentionally (as expected ;-)
If you read it carefully you see that it is in fact
a disclaimer of warranty and liability
(together with a hint to the GPL license)
but it is no GPL license dialog.
This is the crucial point:
For an end-user most of the GPL is meaningless
(e.g. all what belongs to change the code and distribute it)
but what is meaningful for an end-user in any case
is the exclusion of warranty and liability when he runs
the software on his system.
In particular for scanners this is very important because
bugs in scanner drivers or little changes in the scanner
hardware by the manufacturer during the same model series
can cause real hardware damage. For some background information see

in the "Basics" section the paragraph regarding scanner "language".
Because scanner drivers are libraries, they cannot show
a disclaimer of warranty and liability to the user
so that it is up to the scanner frontend to make the user aware
that there is neither any warranty nor any liability.
