It is never a bug when a non-free driver is not included.
It could be an enhancement request for a future openSUSE version.

Your "extremely simple workaround" doesn't work reliably because
there is nothing in plain RPM which can enforce a license dialog.
I.e. there would be no license dialog if the user installs it
via the plain "rpm" command (or via whatever tool which uses RPM).
Therefore from my current point of view we cannot provide this driver
(at least not as an "usual" openSUSE RPM package).

On the other hand we have software packages with a non-free license
on our CDs/DVDs where we show a license dialog via a special magic
in YaST.

Ciaran,
could you comment how we deal with packages with a non-free license
in openSUSE?
In particular how do we make sure that the license dialog appears
in any case?
