It is a big risk to go to court. IBM must be pretty confident that they can successfully defend themselves.
Correct. IBM has made it's share of mistakes, but NOT to the extent other large companies have. There's so much at stake that they'd have to know they can win before going to court. Of course, IBM can delay the process for sometime, outlasting SCO. The risk is that MickySoft would buy out SCO, then IBM would have to deal with Micky.
