That's the wrong place though. System boot scripts should ensure /etc/mtab is in a correct state instead. /etc/init.d/boot.rootfsck used to take care of that. If a non-symlink mtab doesn't work anyways boot.rootfsck should simply make sure the symlink is there instead of creating a regular file if mtab is missing.
